GLE PERFORMANCE LLC RELEASE, WAIVER OF LIABILITY & INDEMNIFICATION AGREEMENT

GLE Performance, LLC’s (“GLE”) primary purpose is the instruction, training and development of athletes in the sport of lacrosse. The use of the training facility and its equipment is strictly ancillary to that purpose. 

You are solely responsible for determining if you are physically fit and/or adequately skilled to participate in our instruction and training. Because physical training can be strenuous and subject to risk of serious injury, GLE urges you to obtain a physical examination from a physician before participating in any training and development classes. You (each client, guest, and all participating family members) agree that if you engage in any physical activity or use any equipment on the premises, or off premises, including any sponsored training event, you do so entirely at your own risk – and that you assume that risk. Any recommendation for changes in diet, including the use of food supplements, weight reduction and/or body building enhancement products are entirely your responsibility, and you should consult a physician prior to undergoing any dietary or food supplement changes. You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury, illness, or death. We are also not responsible for any loss of your personal property. 

This RELEASE, WAIVER OF LIABILITY AND INDEMNIFICATION AGREEMENT (“RELEASE AGREEMENT”) includes, without limitation, all injuries which may occur as a result of: 1) our instruction, training, supervision, or dietary recommendations; 2) your participation in any activity, class, program, personal training or instruction; 3) your use of all amenities and equipment in the facility; 3) the sudden and unforeseen malfunctioning of any equipment; 4) your slipping and/or falling while in the building, or on the premises, including adjacent sidewalks and parking areas; 5) contact with other participants; 6) the effects of the weather, including high heat and/or humidity; 7) and all other such risks being known and appreciated by a reasonable person. I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity. 

I/We acknowledge that I am physically fit and mentally capable of participating in the instruction, training and development program, as well as, performing the physical activity I choose to participate in. 

After having read this RELEASE AGREEMENT, and knowing these facts, and in consideration of acceptance of my participation and GLE Performance instruction, training and development program, I/We HEREBY AGREE, for myself and anyone entitled to act on my behalf, to RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE AND FURTHER AGREE TO HOLD HARMLESS AND INDEMNIFY GLE Performance, LLC, its owners, its officers, agents, employees, organizers, representatives, and successors from any and all liability for loss, damages, costs (including, but not limited to attorney’s fees) , claims or causes of action and you agree to voluntarily give up and waive any right that you may otherwise have to bring a legal action against the GLE Performance, LLC, the owners of the property, and any lessors and lessees, and their respective officers, agents, employees, organizers, representatives and successors on account of injury to my person or property or resulting in my death, whether caused by ordinary negligence or otherwise, arising from my observation, presence, or participation in the instruction, training and development programs , or use of the ancillary facilities or equipment in and about the premises. 

I/We understand that this RELEASE AGREEMENT is intended to be as broad and inclusive as permitted by the laws of the state of New York and agree that if any portion is held to be invalid, the remainder of the RELEASE AGREEMENT shall continue in full force and legal effect. I/We affirm that I/We are of legal age, am freely signing this RELEASE AGREEMENT and that no oral representations, statements or inducements apart from this written RELEASE AGREEMENT have been made. I/We read this form and fully understand that by signing this form, I/We are giving legal rights and remedies that I might otherwise have now or in the future. 

By signing this RELEASE AGREEMENT, I/We acknowledge that I/We understand its contents and that this RELEASE AGREEMENT cannot be modified orally.
